Terms & Conditions
1. These Terms and Conditions of Sale shall be incorporated into all Contracts of Sale made by Top Gift for the sale of any Goods. Any printed or other terms or conditions used by the Customer are excluded and Top Gift shall not be bound by any terms or conditions in the Customer's order. If the Customer's order contains any terms and conditions then these Terms and Conditions of Sale shall take precedence over such terms and conditions in the Customer's order which shall be deemed deleted without notice.
The employees of Top Gift are not authorised to make oral representations as to the description quality or fitness for any particular purpose of the Goods supplied under the Agreement. If a representation is made or an opinion expressed orally which materially affects the Customer's decision to purchase the Goods, the Customer must ensure that any such details are confirmed in writing by the Managing Director of Top Gift so as to form part of this Agreement otherwise no liability can be accepted.
Any typographical clerical or other inaccuracy or omission in any sales literature advertisements quotations price lists acceptance of offer invoices delivery note or any other document or information issued by Top Gift shall be subject to rectification without any liability on the part of Top Gift.
Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Customer's acceptance of these Conditions. All postal methods used are guaranteed delivery services.
Top Gift's sales literature, price lists, other advertising literature or other material do not constitute an offer unless expressed in a fixed quotation open for a specific period and Top Gift reserves the right to withdraw or revise the same at any time prior to the Agreement.
All products on the website are including Value Added Tax (VAT) and any other United Kingdom tax or duty payable.
Goods must be paid for in full. Maintaining security, payments can be made on the website and also with one of Top Gift customer representatives. Customer may use his or her credit or debit card as payment methods.
Where goods are not paid for in full, Top Gift reserve the right to hold dispatch of the goods until total funds are cleared.
Whilst every care is taken to ensure correct prices on our website we do reserve the right to change a price in exceptional circumstances. If a price is corrected due to exceptional circumstances, customers will be informed of the change before payment is processed and offered the opportunity to cancel their order.
3. Availability and Delivery
Acceptance and completion of an order is subject always to the goods which have been ordered being available and Top Gift shall be under no liability for delay or non-performance caused either by the goods being not available or by any circumstances beyond Top Gift’s control.
Top Gift cannot give a time of delivery, unless specified. Any date for delivery given by Top Gift is the best estimate that can be made and Top Gift shall not be liable for any loss or damage (whether direct or consequential). Contact Top Gift for further details.
Top Gift do not deliver any orders outside of the United Kingdom unless by prior mutually agreed arrangements. To protect genuine card holders we do not accept card payments, or COD, for overseas orders under any circumstances. The option for genuine overseas customers wishing to purchase goods is by bank transfer of funds. Please contact our Customer Service Team on for our bank details.
We endeavour to dispatch all in stock accessories within 1 working day of the payment for goods have been made. However we may occasionally have excessive orders, in which case allow up to 28 days for delivery.
Parcels sent to remote parts of the United Kingdom, such as Northern Scotland and parts of Northern Ireland, the Channel Islands and the Isle of Man etc may take longer to deliver.
Once goods have been delivered to the customer. Top Gift are not responsible for any damage or loss to the product(s) after this time.
No waiver or modification of the Terms of this Agreement shall be binding upon Top Gift unless made in writing and signed by the Managing Director of Top Gift.
Top Gift will endeavour to inform the customer of any hindrance or delay of the order however Top Gift will incur no liability for failure to give such notice.
6. Faulty Goods and Defects
If your goods arrive faulty or damaged, or a fault becomes apparent in the first 14 days after delivery, we will either provide a full refund or dispatch new goods as soon as possible after the faulty goods have been returned to us.
If the goods are not faulty you have 7 working days from the day the goods arrive to cancel the order and return the goods at your cost for a refund. A refund will be provided within 10 working days.
The goods must be returned in an unused and re-saleable condition. You are responsible for the cost of safe carriage back to us. The product should be packed in its original packaging. It is essential that there is no damage to any part of packaging. Care must be taken when packing products for transit. You are advised to arrange for adequate insurance to cover the product during its return journey.
Top Gift will repair the goods if they become defective within one year of purchase and the repair will include the supply of labour parts and materials provided the Customer at his cost returns the Goods to Top Gift’s premises, but where such defects arise and are notified to Top Gift more than one year, but less than three years from the date of purchase, may at our own discretion repair the goods at the customers cost. However Top Gift reserve the right to refuse.
Goods which are to be replaced will be dispatched once the original goods have been received.
Top Gift shall have no liability for destruction or damage to the Customer's data howsoever arising including defects in the Goods and for repair or Service undertaken by Top Gift.

The Customer agrees to indemnify Top Gift against any damages losses costs claims or expenses incurred by Accessory Village Ltd in respect of any claim brought against Top Gift by any third party for
Any loss injury or damage wholly or partly caused by the Goods or its use
Any loss injury or damage in any way connected with the performance of this Agreement
8. Product Warranty
All products come with manufacturer's warranty. This warranty does not affect your statutory rights which cannot be excluded or restricted at law.
Additional insurance and extended warranty are not available as yet.
9. Payment Authorisations
By accepting these terms and conditions you agree that Top Gift are authorised to charge your credit or debit card for the goods supplied. You also agree that we are authorised to charge your card with any other charges specified within these Terms & Conditions and within our Returns Policy.
In the event that any amounts becomes due to missing or damaged returned goods, credit or debit card charge backs and dishonoured cheques) and remain unpaid for more than 14 days, we reserve the right to engage the services of a debt recovery agent. Charges incurred as a result of this action will be the customer's responsibility.
10. Returns & Cancellations
You have the right to cancel an order within 10 working days after the day the goods were delivered unless we have previously stipulated to you via email that we are buying the goods in exclusively for you and that you have acknowledged by email that you accept your order cannot be cancelled.
If you wish to cancel your order you must notify Top Gift via email within the stated 10 working day period. Cancellations after 10 working days will not be accepted. Upon notifying Top Gift of your cancellation you will receive information of how to return your order if already shipped. You must return the goods to Top Gift in the same condition and completeness as Top Gift delivered them to you.
The goods remain your property and responsibility until such time as Top Gift signs acceptance of the return delivery of the goods. We strongly advise you to use a secure signed-for service, and you should note that the cost of returning the goods is your responsibility. Should you wish to return any goods, please send us an email requesting your reason for return and ensure you quote your order number so there is not a delay in processing your return.
Any faults that occur within the first 10 days after the goods arrive must be reported to Top Gift within a reasonable time frame, to be eligible for refund or a replacement. If your goods develop a fault after the first 10 days following receipt you have a right to return the goods to us. We will have the goods repaired or send a replacement. This will be confirmed by email.
If the goods are not faulty you have 7 working days from the day after the goods arrive to cancel the order and return the goods for a refund. A refund will be provided within 30 days and will be issued to the same card used to complete your purchase. Please note that packaging must be in pristine condition. Return shipping is at the customer’s expense.
If you wish to return any goods you must notify Top Gift and we will issue you with a unique RMA number if the return is authorised. Please note that you should not send any goods back until you have received this RMA authorisation number, otherwise we will be unable to process your return.
